Comment résilier un contrat de crèche ?

Babilou Family Luxembourg

Are you changing address, losing your job, or wishing to change your daycare? You will need to terminate your contract with your daycare in Luxembourg. To do so, you must write a termination letter. Below, we provide advice on how to respect the termination conditions you agreed upon when registering.

Terminating a daycare contract by letter

To terminate your contract with a private daycare, you must write a letter informing them of your departure. This letter should be sent by registered mail with acknowledgment of receipt or handed directly to the daycare director in person. Be sure to notify them 60 days before the end of the last month of care. If the notice period is shorter, the next month will be charged. If you need to leave your daycare sooner, contact your KidsCare advisor or the daycare director. In certain cases of force majeure, we may reduce the notice period.

Reasons for contract termination

Parents should mention the reasons for terminating the daycare contract in the letter. Reasons can vary widely: moving far from the daycare's location, the child's difficulty adapting to the daycare, financial issues, loss of a job, maternity or parental leave, an event affecting the relationship between the parents and the daycare staff, a long illness, or transferring to a daycare closer to the residence or workplace. Before requesting the definitive termination of your daycare contract, feel free to reach out to the daycare director or contact a KidsCare professional. We can work together to find alternative solutions and arrangements.

Entering kindergarten

Entering kindergarten is not a reason for contract termination mentioned above. In fact, termination is automatic on August 31 of the year your child reaches the age to enter school (unless stated otherwise). Therefore, you don’t need to take any action to end the daycare contract. It will naturally end either at the end of the daycare year or during the summer. If you need a few extra days of care because you're returning to work before the school year starts, check with the daycare director. Your child can still be taken care of before entering kindergarten. If you need childcare outside of school hours or at lunchtime, look into our daycare centers for children aged 4 to 12.

How to write the termination letter

Your termination letter should be addressed to the director of the KidsCare daycare where your child is enrolled. Clearly include your child's name, surname, and date of birth. Then, explain the reason for your termination request and specify the notice period. Finally, the letter should mention the exact date of contract termination, considering the notice period.

Here’s a template to help with the letter:

Location __________
Date __________
Dear Director,
I am writing to inform you of my decision to terminate the contract for my child __________ (name, surname), born on __________. Due to __________ (Indicate the reason for cancelation here), we are unable to continue with our commitment. As we are subject to a notice period of __________ (Indicate the required notice period), I wish to end the contract on __________ (desired end date). I would be grateful if you could let me know how much of the remaining childcare costs I will have to pay.
Yours sincerely,
[Parent signatures]
